Caruana Galizia’s family request a public inquiry into the journalists’ murder

The Opposition led by its Leader Adrian Delia has made the same request in a motion tabled in Parliament earlier this year

The family of the late journalist Daphne Caruana Galizia filed a judicial letter in court requesting for the Government to conduct a public inquiry, to ensure that the state is taking all necessary measures and following all its obligations according to the European Convention of Human Rights, which is also enshrined in Maltese Law.

The judicial letter was filed in the First Hall of the Civil Court (Constitutional Jurisdiction), on behalf of Peter, Matthew, Andrew and Paul Caruana Galizia. The letter is addressed to the Attorney General, the Minister of Justice and the Prime Minister.

The family has requested for the public inquiry should be obliged to also investigate whether the Caruana Galizia murder could have possibly been avoided, and if the Government followed through on its obligations to take the necessary measures, within the circumstances, to advise Caruana Galizia of any danger she may have been in, and if she was given the expected and necessary protection.

The public inquiry would also be expected to investigate if all procedures, processes and administrative structures were sufficient to indicate whether the Government was aware of the danger Caruana Galizia was in; as well as if the said structures were enough to suggest whether additional protection was needed and in its absence, to investigate how the procedures and processes in quesiton could be improved.

The judicial letter also specifies, that unless an independent and impartial person is appointed, and allowed to conduct a proper investigation, the Caruana Galizia family is left with no option but to take legal action against those responsible. The judicial letter was signed by Dr Jason Azzopardi, Dr Eve Borg Costanzi and Dr Therese Comodini Cachia.
